SUBJECT: Members who attended ALS continuing education
during the period of 1/29/05 � 9/30/07
Attached is a grievance settlement concerning the 'payment' of members who were ORDERED to ALS continuing education, at a class sponsored by the Baltimore City Fire Department, during the time period of 1/29/05 - 9/30/07.
In almost all cases, members who attended were given a vacation day in lieu of overtime.
What are you being offered by this settlement?
Any member who attended training during that time period may return a vacation day for each training session and instead receive overtime for the actual amount of hours of the training. Please read the attached settlement agreement.
How do I apply?
Fill out a special report, addressed to the Chief of Fire Department, with a subject of 'Overtime in lieu of vacation days'. List the date(s) of the class you attended, as well as the length of the class. If possible, list any GO'S or DO'S that outlined the specifics of your attendance. Forward them to the Union Office by
What if I do nothing?
The day will remain in your vacation 'bank', available for use or to be 'cashed-in' at retirement.

NOTE: During the time period above, members were ordered to class. Since 9/30/07, members were offered the classes. That is the distinction in the Fair Labor Standards Act.

GRIEVANCE SETTLEMENT

On March 16, 2007, the Office of the Labor Commissioner held a Step Four grievance for Mr. William L. Sheehy (Grievant). The Grievant was awarded overtime compensation for an Advanced Life Support (ALS) training class provided by the Baltimore City Fire Department, which he attended on December 11, 2006. The class counted towards the required continuing education hours needed to retain his Emergency Medical Technician-Paramedic certification. The Grievance decision holding is if a member is ordered by the Baltimore City Fire Department to attend ALS training that is not scheduled during a member’s regular work schedule, those hours count toward hours worked in excess of the regularly scheduled work day or in excess of the regularly scheduled work period for purposes of MOU Article 9. This settlement addresses how Grievance No. 2007-084 will be applied to other members of Local 734 who feel they may be affected by the decision.

Members, if possible, shall make every effort to provide an approximate date or period that they attended mandatory ALS training, provided by the Baltimore City Fire Department, which fits the parameters of the settlement. Members will be compensated with either overtime or compensatory time, at their choice, for any mandatory ALS training attended during the period of January 29, 2005 until September 30, 2007. Overtime or compensatory time will only be given for actual classroom hours attended.
3. If members have already been compensated with compensatory time and/or a vacation day for training dates during the applicable period, such members must return the compensatory time and the vacation day if they choose overtime compensation.

8. This settlement does not apply to any member that chose to attend ALS training/continuing education classes not provided by the Baltimore City Fire Department.
This agreement shall be limited to its facts, and shall not be referred to or cited as precedent in any manner.
